About Boulder County’s Energy Impact Offset Fund (EIOF)

Because of its proportionally significant contribution to climate change, Boulder County is requiring commercial cannabis cultivators to either offset their electricity use with local renewable energy, which now includes RenewableConnect, or pay a 2.16 cent charge per kWh. The fees from this surcharge are then placed into the Boulder County Energy Impact Offset Fund. This fund in turn, can be used to educate and support best in industry practices with regards to energy usage as well as for funding other carbon pollution reducing projects such as low income renewable energy.

Cannabis Injustice Inspires Creation of New Social Equity Certification Mark

The Original Equity Group (OEG) Announces USPTO Approval of the EQUITY TRADE Certification Mark and Launch of National Equity Trade Certification Program.

SAN FRANCISCO — The Original Equity Group (OEG), creators of the first federally-recognized social equity certification  program for cannabis products and other goods, announces the official registration of the EQUITY TRADE certification mark (U.S. Registration No. 6310040) by the United States Patent and Trademark Office (USPTO).

Known for their innovative, community-first approach to social equity, OEG is focused on delivering life-changing solutions to social equity applicants and business owners everywhere. With the recent launch of the Equity Trade Certification (ETC) Program, the company is significantly increasing the visibility of social equity brands by building strategic partnerships with local retailers (“allies”), who will dedicate 20-40% of their shelf space to equity brands. Moreover, the creation of a program where qualified equity businesses can identify their products using an easily-recognizable mark will make it easier for conscious consumers to seek out and buy these products.

Frustrated with the lack of visibility and access being offered to San Francisco Social Equity Applicants by local retailers, OEG strategized as a group to create loose rules (broad standards) for a certification. Led by co-founder Ed Brown, Vice President Nina Parks, and President and Chief Equity Officer Ramon Garcia, OEG began working in 2018 with the city of SF to develop and implement a Social Equity Program (SEP). After the city created the SEP, they began to approve legacy retailers permits to allow them to sell adult-use cannabis products, while equity applicants were still waiting for their applications to be approved. They (The OEG) had heard, from equity businesses like SF Roots, that local retailers were refusing to buy equity products.

This lack of respect for equity-owned businesses infuriated the OEG team and drove them to create the ETC.

OEG sought out the legal support of The Law Offices of Omar Figueroa, who provided (two years worth of) pro-bono hours to help them formalize the certification program and apply for federal intellectual property protection. The EQUITY TRADE certification mark was officially registered  on March 30, 2021(U.S.Registration  No. 6310040 ):

“The certification mark [confirms] that the goods provided have been produced by a business that meets the standards set by a U.S. state, county, or city social equity program that seeks to address social inequalities and policy concerns related to gender and sexuality, race, age, mental or physical disability, class, ethnicity, language, education, civil rights, socioeconomic status or religion, by requiring that a business’s ownership structure, operations, employment practices or charitable contributions demonstrate a commitment to justice and equality. According to the [application / registration certificate], OEG may allow usage of the EQUITY TRADE certification mark by businesses who meet their certification standards, which relate to social justice and equity.”

According to Lauren Mendelsohn, an attorney at the Law Offices of Omar Figueroa, “the Equity Trade Certification program is significant because it is, to the best of our knowledge, the first time a certification mark indicating that a particular product has been produced by an equity business has been, not only created, but also officially recognized by the United States Patent and Trademark Office (USPTO). This will make it easier for customers to seek out and buy these products.”

After creating the ETC, Original Equity Group has been able to successfully advocate for 10 cannabis equity brands to be on the shelves at various dispensaries across California, as well as a growing number of non-cannabis brands throughout the Bay Area made by equity businesses.

“The Equity Trade Certification solves the issue of visibility for equity products. When you look on the shelves in dispensaries, all you see is a bunch of random brands but there is nothing that differentiates equity products from the rest. The ETC is the first equity-focused certification that works to create visibility [for these businesses and their products] under a standard identifier,” shared Brown.

These Black cannabis leaders have agreed to host a  national pre-420 social equity zoom entitled “Challenges, Choices, and  Opportunity in A Billion Dollar Cannabis Industry”. This national social equity zoom will be held on Monday, April 19, 2021 from 1pm-6pm EST. By peeling back  the curtain with concerned stakeholders, regulators, industry leaders and elected officials from around the country, the two cannabis power players are  collaborating and working to bring others to the table to lift up more voices and 

accelerate the social equity conversation and journey that needs to happen in America. 

“There will be more opportunities for cannabis products availability and Black community participation in the next 18 months than we’ve ever seen in legalized adult use recreationalstates. While legalization sparked what has now grown into a billion-dollar industry worldwide, people of color were largely excluded from ownership in legal cannabis, said Bailey. These new social equity  licenses in cannabis legal states present a rare and limited opportunity to make  real progress by providing local governments and states a framework for  which social equity applicants can access these opportunities.” 

Bailey went on further to say, “in order to be a successful cannabis business, our communities must be united around the social equity message. There is a lot of discussion and dialogue going on around social equity, but no clear definition or shared best practices or examples. BCEI and M4MM will take the lead role in  bringing the Black community and stakeholders together on social equity clarity,  social equity definitions and moving the dialogue forward on social equity in  the cannabis industry in the US.“In putting together this collaboration I was looking for progressive people who were as passionate as myself about social equity and had a history of positive community, governmental, and business commitment to leveling the cannabis playing field. 

Roz McCarthy is the first person to come to mind. Roz and I have met over the years and I have admired her work. In discussions we found there was some common ground in our organizational efforts. We shared ideas on working together on social equity corporate – community engagement in the cannabis space, thus the pre-420 social equity zoom was born. We agreed there are so many committed people around the country who believe in social equity, why not join forces and try to pull them together to share information, expertise, time,  talent and hear about the crucial and important work being done.

Solventless, full-spectrum terpene profiles AT SCALE

Vancouver, WA – Cannabis processors seeking quality terpene extract have long been challenged by methodology roadblocks, inconsistent results and scaling issues.

ABM Equipment of Vancouver, WA, and Marion Process Solutions, of Marion, IA, have solved these issues with an innovative design that brings scalability to solventless terpene extraction. Marion announced today that it has achieved patent pending status on the technology, which produces clear, wide-spectrum terpene oil without color-changing contaminants. The approach finally solves the problem of reliable, cost-efficient and high throughput terpene extraction that even outperforms the best CO2 methods being used.

The new system, TXM (Terp Xtract Master) Series™, is particularly ground-breaking for processors because it produces full-spectrum results at scale. Labs have long used a similar method to collect terpene profiles for grams of cannabis at time, but have not had access to scalable solutions. Early validation shows that the TXM Series technology yields a terpene profile that closely matches the original plant profile.

Cannabis and hemp producers have worked for years without success to produce clear, highly matched terpene extracts at a premium level, to function as additional revenue streams for growers, processors and retailers.

While prior solutions used solvents to attract the terpenes that then required post-processing steps for removal, the TXM Series relies on microwave drying technology to vaporize the water inside the plant material which acts as a vehicle for terpene removal. The resulting terpenes then enter a condenser “cold trap” unit integrated into the system.

Marion testing of hemp samples yielded Certificates of Analysis (COA) to verify that the process preserves extractable cannabinoids in the plant material after removing the terpenes, increasing the total value of the material. This method is well suited to deterpenate “fresh frozen” material since it utilizes the water in the plant whereas other techniques require drying the material prior to extraction.

In addition to solvent-free purity, the TXM Series’ microwave technology enables a lower operating cost in the US than alternative gas-generated heat steam extraction systems and solutions that require additional solvents or CO2 costs. In addition, the TXM Series offers customers 98% more rapid throughput as it is able to finish dry material in the same vessel, for a far more scalable solution – drying 1.5 pounds of materials in 45 minutes, versus the two days it would take to hang dry.
